1. Acceptance of the Terms

   By using and/or visiting this website, you agree to and accept the following Terms of Use as well as the terms and conditions contained in the Privacy Policy as posted on the RedfishCasting.com website. If you do not agree to the referenced terms and conditions, then please do not use the website or services of RedfishCasting, L.L.C. (herein referred to as RedfishCasting or Redfish).

2. Modification of Terms

   RedfishCasting reserves the right to modify the Terms of Use and Privacy Policy at any time. Modifications to these terms and conditions apply to all users of our website and services, and the changes are immediate.

3. Access to Website and Services

   1. RedfishCasting hereby grants you the right to use the features and services of this website provided that: (a) the use of this website and the content provided on this website is for personal use only. It is not to be resold, repackaged, or redistributed in any way; (b) you agree to and abide by the Terms of Use and Privacy Policy.

   2. In order to utilize the services and access the retail content of this site, you must create a unique customer account. You must provide accurate information when creating your user account. Security of the login information is your responsibility. If your login information is lost, you must notify RedfishCasting immediately. All content and services purchased and used are the responsibility of the account holder. Any losses you suffer as a result of unauthorized use of your account are your responsibility. RedfishCasting will not be liable for any unauthorized use of your account.

   3. You agree not to harvest any information off of any RedfishCasting website or a website of one of our associates without our express consent. We consent to the use of our website contents for public search engines, which display our website contents to those utilizing the public search engine services.

   4. Any attempt to compromise the security of our system in order to obtain customer information, or any denial of service attacks that can be associated with an account holder will revoke all rights of that account holder, including the receipt of services purchased, but not yet obtained. Any attempt to disrupt our service offering or compromise our security will also result in legal action on the part of RedfishCasting, L.L.C. against the offenders.

4. Intellectual Property

   The content of the RedfishCasting website is owned in its entirety by RedfishCasting and/or the providers of the copyrighted content available on our website. We retain the copyrights of all materials on this site unless it is directly referenced as copyrighted by another entity. In that case, it is licensed to RedfishCasting for sales and distribution.

   We treat all copyrighted materials that we distribute as the property of RedfishCasting. We will not allow the content to be resold, repackaged, or redistributed without the express written consent of RedfishCasting or the copyright holder.

5. Training Materials

   Some professional training materials are presented on the RedfishCasting.com website. These materials are to be used only by trained professionals who have the experience and judgment within their respective industry to apply the ideas conveyed in a manner that will benefit all. These training materials are not to be used as a primary form of professional education, but only serve continuing education purposes.

   RedfishCasting provides these materials for sale and distribution only. Comments and questions about the content of the training materials should be conveyed directly to the copyright holder of the work being distributed. The copyright holder and their contact information is prominently displayed on the work itself.

   Some of these training materials are distributed with a Certificate of Completion. These certificates are issued by RedfishCasting, and only verify that the user has viewed the training materials so as to obtain Continuing Education Units. It is the responsibility of the user to maintain the record of their CEUs. RedfishCasting assumes no liability for maintaining the certifications of the professional. The professional trade organization that recognizes the training materials as credible for obtaining Continuing Education Units is clearly identified at the time the training materials are sold and presented. Questions about maintaining professional certifications need to be directed to that particular trade group.

   RedfishCasting, L.L.C. as distributor of these works, assumes no responsibility for the contents of the training materials.

6. Purchase of Webcast Content

   When purchasing webcast content, you are purchasing the right to view that content for a limited time and/or a limited number views within a given time period. Webcasts are offered as a convenience, and are not meant as a primary means of viewing our content. If you wish to purchase content so that it can be viewed multiple times, or viewed at a latter date, we recommend you purchase a DVD from our website. RedfishCasting will offer the webcast for viewing per the purchase terms as shown on the purchase page.

   Due to the many elements of webcast delivery that RedfishCasting has no control over, RedfishCasting does not guarantee uninterrupted delivery of content during a webcast. If your webcast is interrupted for any reason, you may replay the webcast by reconnecting to the RedfishCasting website and restarting the webcast. If, for any reason, you are not able to view the webcast at all, you may be eligible for a refund. In order to obtain a refund for a webcast purchase, you must contact RedfishCasting directly by email or phone. A refund will only be offered at the discretion of RedfishCasting.

   In the event that RedfishCasting detects an abuse of the webcast service, either by repeated viewings of content by a single computer, or by repeated viewings of webcast content by multiple computers sharing similar account credentials, without the consent of RedfishCasting, we reserve the right to bar the account from further webcast usage.

7. Purchase of DVD Content

   When purchasing DVD content, please note that shipping and handling is in addition to the retail price of the DVD. Shipping and handling costs are fully disclosed at the time of sale.

   RedfishCasting does not offer refunds for DVD sales. If the DVD is defective upon receipt, RedfishCasting will replace the defective DVD with another copy of the same DVD. We offer this replacement warranty on defective merchandise for 30 days.

8. Unauthorized Usage

   Activity on your account is your responsibility. RedfishCasting will not refund activity for unauthorized usage. If you fear that your account security has been compromised, then contact us immediately by email or phone, or change your account password by logging into https://www.redfishcasting.com:8080/secure/account/login.php

9. Access to Account Charges

   At any time you can view your account activity by logging into your account at https://www.redfishcasting.com:8080/secure/account/login.php. In addition to purchases and billings, you can view content viewed and professional certificates received.

10. Default

    If for any reason a payment for services rendered or products delivered is reversed or not honored. RedfishCasting reserves the right to pursue collection of the default amount through any means necessary. We will also bill additional charges for efforts expended and services retained through the collection process.

11. Notices

    Written or email notices to you shall be effective 3 days following the date deposited in the U.S. Mail addressed to your address as kept in our files or following the transmittal to you over the internet subject to the email not being returned back to us. Any returned email notices shall be resent, or we will use other available methods of contacting you. Oral notices shall be deemed effected on the date reflected in our records. We will not give you notice of any subpoenas or court orders related to your account or use of Service unless required by law.

12. Warranty Disclaimer

    YOU AGREE THAT YOUR USE OF ANY SERVICE OR CONTENT ON THE REDFISHCASTING WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW REDFISHCASTING, ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND ITS CONTENT AND YOUR USE THEREOF. REDFISHCASTING MAKES NO WARRANTIES ABOUT THE ACCURACY OR VALIDITY OF THE CONTENT ON THIS WEBSITE. REDFISHCASTING ASSUMES NO LIABILITY FOR; (a) ERRORS, MISTAKES, OR INACCURACIES IN THE CONTENT ON THIS WEBSITE; (b) PERSONAL INJURY OR PROPERTY DAMAGE AS A RESULT OF USING THIS WEBSITE OR ANY OF THE CONTENT DISTRIBUTED THROUGH THIS WEBSITE; (c) ANY UNAUTHORIZED ACCESS OF THIS WEBSITE OR ANY SECURITY BREACH THAT RESULTS IN THE LOSS OF PERSONAL AND/OR FINANCIAL INFORMATION; (d) ANY TEMPORARY LOSS OF SERVICE, INACCESSIBILITY BY USERS, OR INTERUPTION OR CESSATION OF TRANSMITTION WITH THIS WEBSITE AS A RESULT OF ANY ACTION ON THE PART OF REDFISHCASTING OR ANY OF ITS SERVICE PROVIDERS; (e) ANY BUGS, VIRUSES, TROJAN HORSES, SPYWARE OR THE LIKE THAT MAY BE TRANSMITTED THROUGH THE REDFISHCASTING WEBSITE BY A THIRD PARTY; (f) ANY SERVICE OR PRODUCT OFFERED BY ANY THIRD PARTY ADVERTISING ON THE REDFISHCASTING WEBSITE; (g) ANY SERVICE OR PRODUCT OFFERED BY ANY WEBSITE THAT IS IN ANY WAY HYPER-LINKED TO THE REDFISHCASTING WEBSITE. AT ALL TIMES USE YOUR BEST JUDGEMENT WHEN VIEWING CONTENT ON OUR WEBSITE AND EXERCISE CAUTION WHERE APPROPRIATE.

13. Limitation of Liability

    IN NO EVENT SHALL REDFISHCASTING, L.L.C. ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CENSEQUENTIAL DAMAGES RESULTING FROM THE USE OF THIS WEBSITE OR USE OF ANY OF THE CONTENTS DISTRIBUTED THROUGH THIS WEBSITE FOR ANY REASON.

14. Indemnification

    You agree to defend, indemnify, and hold harmless, RedfishCasting, its officers, directors, employees and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney?s fees) arising from; (a) your use of and access to the redfishcasting.com website; (b) your violation of any of these Terms of Use; (c) your violation of any copyrights of works available on the redfishcasting.com website; (d) your violation of any third party right, including without limitation any copyright, property, or privacy right; (e) any claim against you as a result of your activities on or training you received from the redfishcasting.com website.

15. Assignment

    These Terms of Use, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by RedfishCasting without restriction.

    Governing Laws. You agree that: (a) the RedfishCasting website is solely based in Texas; (b) RedfishCasting operates under the laws and jurisdiction of Texas, and any legal proceedings against RedfishCasting will take place under the jurisdiction of Longview, Texas courts. (c) if there is any inconsistency between federal, state, or local laws and this Agreement, then this Agreement shall be deemed amended as necessary to conform to such regulations.

16. Entire Agreement

    These Terms of Use and Privacy Policy, together with any other documents directly or indirectly made a part of these Terms, represents the entire Agreement between you and RedfishCasting. This Agreement supersedes any inconsistent or additional promises made to you by any of our representatives, agents or dealers. If any part of this Agreement is found invalid in a court of law, the balance of the Agreement remains enforceable.
